accident claim

I met with an accident on 25th December, 2006. A bike with 2 persons hit my car from the right side when I was taking a right turn and both got injured when their bodies hit against the divider. I took them to the hospital where they got treatment and both are ok at the present moment. They filed a case on 22th Feb, 2007 (almost 2 month later) in which they have claimed a compensation of Rs. 18 Lac. We have been fighting the case for the last 2 years but due to the large number of witnesses (15, none of whom were there at the time of accident except those 2 injured) that they have deliberately put, the case has been dragging. Their case has fallen weak since it's based on false statements and they have stopped coming to court inspite of warrants. For the last 8 months, no one has come and our lawyer says that this is the procedure of the court where the one accused will have to wait till the accuser comes. I have first level insurance which is part of their claims and the insurance company would pay for it but they are not coming for settling that as well. I'm finding myself helpless in the light of their absence and our lawyer's statements when I know that this should have been settled in my favour long back. Is our legal system so much in favor of the one who files a case ? What options do we have now to speed up the process ? I would be obliged if you could answer my worries.

you can file a writ petition in the high court for speedy disposal of the case .
